Privacy and Cookie Policy

Dativa has developed the Privacy and Cookie Policy rules with the aim of explaining our data processing practices and your options regarding how your personal data is collected and used. The Privacy Policy applies to data processing regardless of the form and/or environment in which you provide personal data (on the Dativa Website, by email, in paper format, or by phone), and in which Dativa systems or paper-based filing systems they are processed.

General Provisions

This website – www.dativa.lv (hereinafter – the Website) belongs to SIA Dativa, registration number: 40003278467, registered address Elizabetes iela 41/43, Riga, LV-1010, Latvia (hereinafter – Dativa). Dativa is committed to protecting the privacy of personal data in its possession and to processing, collecting and retaining only such personal data that has been lawfully obtained and is necessary for carrying out Dativa’s business activities, fulfilling regulatory requirements and contractual obligations, and ensuring lawful data processing.

Dativa’s privacy policy is implemented in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data – the General Data Protection Regulation – and other legislative acts of the Republic of Latvia and EU institutions that apply or may be applied to this policy.

Possible Cases of Data Processing

Dativa, in pursuing its legitimate interests related to the conduct of business activities as well as the protection of property and employees, envisages processing personal data which may be necessary:

  • to be able to conduct its business activities;
  • to promote improvements in the quality of goods and/or services;
  • for the development and advancement of new goods and/or services;
  • for customer service and its improvement;
  • for handling and processing complaints;
  • to prevent unjustified financial risks to its business activities;
  • for debt recovery and collection;
  • to analyse the operation of the Website, and to develop and implement improvements;
  • to send other notifications related to the progress of contract performance;
  • to conduct customer surveys on goods and services and their usage experience;
  • to prevent fraudulent activity.

In cases where personal data is used for specific purposes to ensure Dativa’s legitimate interests, the data subject will be informed separately, in the manner prescribed by applicable law.

Data Collection and Use

Dativa collects personal data when a person chooses to provide such data, for example, an email address for communication or registration to receive services. In certain cases, a person may have previously provided personal data to Dativa (for example, if the person is a former employee). By registering and/or providing personal data to Dativa, the person agrees that this information may be used in accordance with the privacy terms set out in this document. Personal data is not used for any other purposes unless Dativa obtains the person’s permission or if required or permitted by law or other binding regulations. For example, if a person sends Dativa an email with an information request, Dativa will use the person’s email address and other information provided/indicated by the person to respond to that request. If a person submits CV information, Dativa will use the provided information to assess suitability for available vacancies.

Dativa collects “sensitive” personal data only when the relevant persons provide this information voluntarily, or when the collection of such information is required or permitted by law and/or other regulatory enactments. Sensitive information includes personal data relating to a person’s race, ethnic origin, political views, trade union membership, religious or similar beliefs, physical or mental health, sexual life, or criminal record. Please be careful when providing sensitive information.

Third Parties

Data processing at Dativa will be carried out by duly authorised employees. Companies with which Dativa has concluded an appropriate agreement may be engaged to carry out certain processing activities. Dativa may transfer data subject’s data to its suppliers, subcontractors, strategic partners, and others who assist Dativa and its clients in conducting business activities in order to implement the relevant cooperation. However, in such cases, Dativa will require these recipients to commit to using the received information only for the purposes for which the data was transferred, and in accordance with applicable regulatory requirements.

Dativa does not disclose personal data or any information obtained during the term of a contract to third parties unless it is necessary:

  • under the contract, to perform a function required for the performance of the contract or delegated by law (for example, to a bank for settlement purposes);
  • in accordance with the clear and unambiguous consent of the data subject;
  • in cases provided for by regulatory enactments (for example, laws and Cabinet of Ministers regulations), in the manner and to the extent prescribed therein;
  • to protect Dativa’s legitimate interests, for example, by taking legal action or approaching other public authorities against a data subject who has infringed Dativa’s legitimate interests.

Transfer of Data to Other Countries

Dativa undertakes not to transfer personal data to an organisation or any other person located in a country that does not ensure an adequate level of personal data protection, except in the following cases:

  • the transfer is necessary to conclude or perform a contract with the person, or the contract has been concluded in the person’s interests;
  • the transfer is permitted in accordance with applicable regulatory requirements;
  • the person has given their consent.

Data Retention Period

Dativa will retain personal data information for as long as necessary to:

  • fulfil the purposes set out in this policy, unless longer retention is required or permitted by applicable regulatory enactments;
  • provide the products, services, and information requested by the person or the person’s company;
  • communicate with the person regarding a request submitted to us;
  • administer the choices and rights that the person has exercised in accordance with this privacy policy;
  • ensure the handling of requests, legal protection, resolution of issues, observance of limitation periods, etc., as well as to take into account the rights provided for natural persons, for example, by setting data retention for a period during which claims related to transactions could be filed, should such arise.

Rights of Individuals

A data subject (person) has the right to receive information prescribed by regulatory enactments in connection with the processing of their data:

  • specific information about what personal data Dativa holds about them, for what purposes Dativa processes this personal data, information about the categories of recipients of personal data (provided that regulatory enactments in the specific case permit providing such information), information about the period for which personal data will be stored, or the criteria used to determine that period, as well as information about the data source, if personal data is not collected from the data subject;
  • in cases provided for by regulatory enactments, the person has the right to request the correction of their personal data if the person believes that the information held by Dativa is outdated, inaccurate, or incorrect;
  • the person has the right to request the erasure of their personal data, or to object to processing, if the person believes that the personal data has been processed unlawfully, or is no longer necessary in relation to the purposes for which it was collected or otherwise processed;
  • other information, if directly provided for by regulatory enactments.

A person may submit a request to exercise their rights by sending a written request to Dativa’s registered address or by sending an email signed with a secure electronic signature to info@dativa.lv

The person’s request must specify the preferred method of communication. Dativa will take into account the person’s indicated method of communication to the extent possible. Upon receipt of the request, Dativa will assess the validity of the request and fulfil it, or provide a reasoned response to the person no later than one month from the date of receipt of the request.

Dativa ensures compliance with data processing and protection requirements in accordance with regulatory enactments and, in the event of a person’s objection, takes all possible steps to resolve the objection.

Cookies

Cookies are small text files that are sent to the memory of a computer or mobile device (hereinafter referred to in the singular and/or plural as the Device) during a visit to the website. On each subsequent visit, cookies are sent back to the originating website or to another website that recognises the cookie. Cookies act as the memory of a specific website, allowing that website to remember the Device on subsequent visits, including that cookies can remember settings in order to improve user convenience.

Google Analytics

SIA Dativa uses Google Analytics, an analytics tool provided by data processor Google Inc. In accordance with Google Inc. Terms of Service and Google Analytics Terms of Service, Google will use the aforementioned information to evaluate, on behalf of SIA Dativa, how a person uses the website, and to prepare reports on user activity on the website.

If a person does not consent to the use of Google Analytics cookies placed on this website and has clicked “I do not consent”, these cookies will not be stored on the person’s Device.

Use of Cookies

The website uses session cookies, persistent cookies, and third-party (partner) cookies in order to:

  • ensure the functionality of the website;
  • remember whether consent has been given for the use of our cookies, including the privacy policy;
  • compile statistics;
  • obtain analytical statistical data on visitor traffic to the website using Google Analytics (number of visitors, time spent on the page, etc.);
  • analyse analytical data and develop website improvements.
